Mindful Nature Connection Walks 2024

Introduction

These Terms relate to the delivery of our Mindful Nature Connection Walks being held at The Surrey Wildlife Trust, Mill Way, Leatherhead, KT22 8QA.

We pride ourselves in providing a high level of customer service and ensuring that you are clear in respect of all of your rights relating to your participation on our mindful activities and events.

PLEASE READ THESE TERMS CAREFULLY BECAUSE THEY SET OUT IMPORTANT INFORMATION RELATING TO THE DELIVERY OF OUR SERVICES FOR OUR WALKS. BY SIGNING THE AGREEMENT, YOU ARE AGREEING TO BE BOUND BY THE TERMS IN FULL WITHOUT VARIATION.

This Event Waiver and Release of Liability (“the Agreement”) is between Kora Coaching and Therapy (“the Company”), a sole trader, whose registered office is at 111 Shelvers Way, Tadworth, Surrey, KT20 5QQ, and you, the even attendee (“the Participant”).

Mindful Nature Connection Walk       

  1. The walks include: 50 mins of guided walk, including guided meditations and visualisations, gentle & slow walking, sensory awareness exercises, forest and nature connection activities which will vary each month.
  2. All  Participants must remain with the group at all times during the walk.
  3. The Participant is expected to dress appropriately for outdoor activity and conditions, bring a drink and any medication or other items they may need to ensure their safety, comfort and wellness.
  4. No shorts or cropped tops are permitted to be worn on the site (this decreases the likelihood of ticks attaching to the body). Surrey Wildlife Trust recommends that all visitors have a bath/shower when back home after their visit to check for ticks that may be on the skin. They also recommend that all clothes worn at the visit are washed.
  5. The centre is a nut-free centre. Please do not bring any nuts on site for the safety of staff and visitors.
  6. The Participant needs to be moderately fit to attend these walks and be able to walk for  2 km and be able to walk on uneven or slippery ground.
  7. This is a free activity for women held on the 3rd Friday of each month, unless otherwise notified.
  8. Smoking, drinking and drugs will NOT be tolerated.
  9. Mobile phones must be turned off or set to silent during your presence on site to avoid disruptions to sessions taking place.
Payment, Refund and Cancellation Rights
 
In order to secure your place, the Participant will make a payment on Eventbrite which shall reserve the Participant’s place on the walk and prevent others from booking that spot. Participants who have not booked through this route will not be able to attend unless agreed directly with a member of the Company.
All participants are required to notify the Company, if they are unable to attend.
The non-refundable booking fee is not refundable in any circumstances.
  1. Pricing by the Company is regularly reviewed. The Company reserves the right to increase or discount prices as required to optimise bookings. Occasionally rates will increase between the time you are quoted and making the booking or final deposit. It is completely at the company’s discretion to honour any quoted rate and may depend on time lapsed between the enquiry and paying the booking deposit.
  2. The Company reserves all rights to postpone or cancel the walks for any reason due to illness, extreme weather, COVID-19, or any other reason, whether foreseeable or unforeseeable, and in such circumstances the Company shall provide the Participant with as much notice, including a revised date if available, as possible.
  3. The Company shall not be responsible for sums associated with travel costs for any reason.
  4. Where the walk is rescheduled, where possible, the Participant will be reserved a place for the revised date. In circumstances where the Participant is unable to attend the revised date the Company will, at its complete discretion, permit attendance at another in-person event. In no circumstances will a monetary refund be offered by the Company.
  5. The Company reserves all rights to postpone or cancel the walks for any reason due to illness, extreme weather, COVID-19, or any other reason, whether foreseeable or unforeseeable, and in such circumstances the Company shall provide the Participant with as much notice, including a revised date if available.
 
Health & Safety
 
  1. At all times participant health and safety is of paramount importance to the Company. Participants must disclose any health conditions that may affect their ability to attend or participate on the mindful walks.
  2. The Participant is responsible for their own health and wellbeing at our events and recognises that these are voluntary events.
  3. All participants must provide the name and contact details for an emergency contact.
  4. At all times Participants must comply with the rules and safety instructions provided to them by the Company in order to protect the health and safety of all in attendance.
  5. All Participants must arrive on time for the initial safety briefing by the Company otherwise they will not be permitted to attend if arriving late.
  6. Participants who are late will not be able to enter The Wildlife Trust woods unattended or cause interruption to the group due to the nature of activities, therefore if the Participant has missed the initial briefing, they should remove themselves from site for health & safety reasons.
  7. The Company is not responsible for the vaccination status and/or risks associated with the transmission or exposure of COVID-19 or any other illness. The Company reserves the right to implement COVID-19 secure measures at their total discretion.
  8. The Company will undertake risk assessments for the routes undertaken at Surrey Wildlife Trust and these will form part of the safety briefings for Participants.
  9. The Participant must make the Company aware of any special needs or special duty of care prior to booking on the walk.
  10. The Company is not responsible for any damage to Participants clothing/footwear or any other effects.
  11. The Participant may park on site at their own risk.
  12. All contact with the natural world (whether in your garden at home or a nature reserve) has risks. The Company has completed a full risk assessment to minimise these. However, there are a number of illnesses of which you should be aware. (More information can be found on the Health Protection Agency website www.hpa.org.uk) and we provide details of related illness on the safety guidance sheet sent to all participants.
 
Warranties, Disclaimers and Liabilities
  1. Participants must leave the Trust woodland as they found it, remove all rubbish (take it home)  and avoid any unnecessary damage to the environment.
  2. The Company holds public liability insurance which covers their walks inside the UK, and requires Participants to be accompanied by the Company at all times and the Participant attends accepting the risks and hazards associated with outdoor activities.
  3. The Company make no representations as to the content, timetable or delivery of the Mindful Walks, which is subject to change at short notice. Walks may sometimes be variable in duration and levels of participation required. Participants are responsible for their health and safety, acting on briefing information and must show consideration for the safety of others.
  4. Nothing in these terms will (a) limit or exclude any liability for death or personal injury resulting from negligence; (b) limit or exclude any liability for fraud or fraudulent misrepresentation; (c) limit any liabilities in any way that is not permitted under applicable law; or (d) exclude any liabilities that may not be excluded under applicable law.

Data Protection, Confidential Information and Intellectual Property

  1. Any personal data collected by the Company in connection with the performance of this Agreement will be handled in accordance with the Company’s Privacy Policy.
  2. During the course of the Mindful Walks, Participants may have access to confidential information, in particular the personal and business affairs of others on the walks. In accepting these terms, the Participant agrees not to use or disclose to any person, organisation or company, and shall use their best endeavors to prevent the publication of any confidential information relating to any other Mindful Walk participant.
  3. Participants accept that any unauthorised disclosure of personal or confidential information belonging to another may amount to immediate dismissal from the event.
  4. The Company requires that all participants respect the rights of others in respect of their behaviour and privacy. The Company will not be responsible for the action of any participant, including for any disclosures made by any participant based on information which has been shared during the Mindful Walk, and each participant should be aware that whilst all participants have been requested to maintain the strictest confidentiality, private information should not be shared if wider disclosure could cause further implications.
  5. All participants are requested to be kind and courteous to other participants, contractors or employees at all times. the Company reserves the right to remove any participant from the Mindful Walk immediately, should they consider that there has been inappropriate behaviour. Kora Coaching and Therapy do not tolerate bullying, racism or sexism of any kind.
  6. All intellectual property rights within the expertise/training delivered throughout the Mindful Walks by the Company are owned by Kora Coaching and Therapy and the reproduction, distribution, whether by gift or sale, of any information or materials provided is strictly prohibited. This means that whilst Participants are free to use the material or print out a copy for their own use, participants are not permitted to copy, distribute, adapt, edit or share our products with third parties.

Law and Jurisdiction

  1. These terms and any claim or dispute arising in relation to them will be governed by English law. The courts of England shall have exclusive jurisdiction to settle any such claim or dispute.
  2. No breach of any provision of this Agreement shall be waived except with the express written consent of the party not in breach.
  3. If any provision of this Agreement is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions of this Agreement will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant provision will be deemed to be deleted).
  4. Neither party may without the prior written consent of the other party assign, transfer, charge, license or otherwise deal in or dispose of any contractual rights or obligations under this Agreement.
  5. This Agreement is made for the benefit of the Parties and is not intended to benefit any third party or be enforceable by any third party. The rights of the Parties to terminate, rescind, or agree any amendment, waiver, variation, or settlement under or relating to this Agreement are not subject to the consent of any third party.
  6. This Agreement shall constitute the entire agreement between the Parties in relation to the subject matter of this Agreement, and shall supersede all previous agreements, arrangements and understandings between the parties in respect of that subject matter.

 

PARTICIPANT AGREEMENT

By joining this event:

I confirm that I have read this Agreement and understand the terms and the implications of the waiver. I provide consent freely and understand that if I am uncertain as to the extent by which I am bound by the terms of this waiver I can, and should, seek legal advice.

I understand that:

  1. There may be risks arising from contact with other participants, or injury by participants or the nature of the activity, whether accidental or not.
  2. As a Participant you agree and fully understand and accept that outdoor activities can involve certain additional risks, hazards and dangers to health and life.
  3. As a Participant I must be over 18 years of age to attend.
  4. As a Participant I am not permitted to bring any pets, additional guests or children.
  5. I may face risks relating to COVID-19 and that it is my personal responsibility to consider the medical advice and relevant government guidance and independently consider my personal risks before making my decision to attend the event.
  6. I may be asked to comply with COVID-19 safety requirements such as wearing a mask for the duration of the event and/or adhering to social distancing measures.
  7. If I am displaying symptoms of COVID-19 and/or have tested positive and/or have been in contact with someone who has tested positive for COVID-19, I will not be permitted to attend the event.
  8. Photographs and video images will be captured throughout the event and I am being asked to, and grant permission for my image, video footage, likeness, sound of voice on audio and video to be used without payment or any other consideration now or in the future. I understand that any audio or visual content may be edited, copied, published and distributed and I waive my rights to inspect or approve the final product.
  9. Any photographs or video content captured may be used for the intended purposes of promotional or marketing material, education videos and or course and informational videos which may be used and shared online/on the Internet, downloaded and stored and that no geographical or time restrictions are placed on the use of the material.
